Being in, or having been in, an insolvency doesn’t stop the lending being looked at. But it can change who receives any refund.
IVAs
Refunds for debts included in an IVA are often treated as an asset of the IVA and paid to your creditors through your insolvency practitioner, sometimes even after the IVA has ended. Speak to your insolvency practitioner before complaining: they may already be claiming.
Bankruptcy
A refund on borrowing from before your bankruptcy usually belongs to the bankruptcy estate, so it goes to the Official Receiver or trustee for your creditors, even after you’ve been discharged.
Debt relief orders
DROs are different and the position depends on timing. Get free advice from StepChange or National Debtline.
Borrowing after an insolvency
Lending you took out after an IVA, bankruptcy or DRO ended is usually yours to claim for, and a lender lending to someone recently insolvent may well have lent irresponsibly.
When you do our check, tell us about any insolvency so we can pass your claim to a firm that can deal with it.
