Who we are
RFLCS Ltd (trading as Claims & Refunds) is the data controller for the information you give us on this website. ICO registration ZA840691. Contact: info@claimsandrefunds.co.uk, 21d Chudleigh Road, Alphington, Exeter, EX2 8TS.
What we collect
- Your name, date of birth, mobile number, email address and addresses for the last three years
- Your answers about your borrowing or car finance, and the lenders you name
- Your consent, with the date, time and internet address it was given from
- Messages you send us
- Where you came to us from (for example an advert), if you clicked a link with that information
- If you use our lending check with Recoup: your first name, mobile number and email address, which boxes you ticked, and whether you went on to sign up with Recoup
Why we use it
- To check your claim and introduce you to a firm, with your consent, which you give when you send your check.
- To keep you updated, for example to tell you which firm has your claim and to check they’ve been in touch.
- To keep records we must keep as an FCA-regulated firm (legal obligation), and to deal with complaints.
- To send you your link to our partner’s check, and one reminder if you asked for one (your consent, which you can withdraw at any time).
- To tell you about other claims, refunds and offers from Claims & Refunds by email and text, only if you ticked the box to say yes (your consent). Every message has a way to unsubscribe.
- To run and protect our website and stop spam (legitimate interests).
Who we share it with
If a regulated law firm or claims management company can help with your claim, we pass them your details so they can contact you. We email you to tell you who they are. They then become responsible for your information under their own privacy policy.
For lending checks, we send you to Recoup, a trading style of Clear Legal Limited (a law firm regulated by the Solicitors Regulation Authority, SRA 469975), where you sign up with them yourself. We don’t pass them your details: we add a reference number to the link so they can tell us whether you signed up. Anything you give Recoup is covered by their own privacy policy.
We also use trusted suppliers to host our website and send emails. We don’t sell your information or use it for anyone else’s marketing.
How long we keep it
We keep your claim details for 6 years from our last contact with you, because of our regulatory record-keeping duties and so we can deal with any complaint. Then they’re deleted automatically.
If you used our lending check and didn’t ask for updates, we delete your contact details 12 months after you used it. If you asked for updates, we keep your details until you unsubscribe. After that we keep only your email address and mobile number on a do-not-contact list, so we don’t message you again.
Your rights
You can ask for a copy of your information, ask us to correct it, ask us to delete it or stop using it, and withdraw your consent at any time (this won’t affect a firm that already has your claim; contact them too). Email us to do any of these. You can also complain to the Information Commissioner’s Office at ico.org.uk.
Cookies
